1. Scope and Definitions

1.1 The following General Terms and Conditions (GTC) apply to all business relationships between PetRhein GmbH, Bayernstr. 14, 30855 Langenhagen/Hannover (hereinafter referred to as "we", "us") and the customer (hereinafter referred to as "customer") via the online shop www.astropet.de and www.petrhein.de.

1.2 "Customers" in the sense of these GTC are both consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB.

1.3 Deviating, opposing, or supplementary general terms and conditions of the customer do not apply unless we have expressly agreed to their validity in text form.

2. Conclusion of a Contract, Storage of the Contract Text

2.1 The following regulations on the conclusion of a contract apply to orders of products and services that we offer in the online shop on astropet.de or petrhein.de.

2.3 The presentation of products in the online shop does not represent a legally binding offer on our part, but a non-binding invitation to the customer to order products.

2.4 The ordering process is as follows:

(a) Customers order via the online shop.

(b) By clicking the "Buy Now" button, you submit a binding offer to conclude a contract. Beforehand, you have the opportunity to check and correct the contents of the shopping cart and your address details.

(c) After you have submitted your order, you will receive a confirmation email. This does not yet represent a binding confirmation of the contract. The contract is either concluded by a separate email (order confirmation) or by sending the goods. If no order confirmation, notification of dispatch, or goods are received within 7 days, the customer is no longer bound by the offer.

2.5 Order cancellation and reservation of rights (a) We reserve the right to cancel or not accept orders if there is a justified suspicion of abusive use of our online shop. This applies particularly, but not exclusively, in the following cases:

• Unauthorized access to our IT systems or security vulnerabilities
• Manipulation of prices, coupon codes, or other ordering functions
• Circumvention of technical protective measures
• Multiple use of coupon codes or discounts contrary to the intended terms of use
• Any other form of misuse of our electronic systems

(b) In the cases mentioned above, we are entitled to withdraw from the contract and refund any payments already made. We reserve the right to permanently exclude the relevant customer from purchasing in the event of repeated misuse.

(c) In the event of an order cancellation, we will inform the customer immediately by email.

3. Right of Withdrawal

3.1 The customer has the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which the customer or a third party named by the customer has taken possession of the last partial shipment or the last piece.

3.2 To exercise the right of withdrawal, the customer must inform us (PetRhein GmbH, Bayernstr. 14, 30855 Langenhagen, Email: service@astropet.de or service@petrhein.de) of their decision to withdraw from the contract by means of a clear statement (e.g., by email).

3.3 In the event of a withdrawal, we will cover the return shipping costs and provide the customer with a return label.

4. Prices and Shipping Costs

4.1 All prices are net prices and include statutory VAT and any applicable shipping costs.

4.2 Shipping within Germany is free of charge for orders with a value of 100 € or more. For deliveries abroad, the shipping costs are 19.99 €. Additional shipping costs will be displayed during the ordering process.

5. Delivery, Transfer of Risk

5.1 Deliveries are only possible within the EU. The delivery time is usually specified in the product description on the website.

5.2 The risk of loss and damage to the product passes to the customer as soon as the goods are handed over to the logistics service provider.

5.3 If delivery is delayed due to unforeseen circumstances, we reserve the right to reschedule the delivery date after consulting with the customer.

6. Retention of Title

6.1 Until full payment is made, the goods remain our property. Pledging or other disposition of the goods without our consent is not permitted.

7. Statutory Defect Liability and Warranty

7.1 The statutory warranty rights apply. The warranty period is two years from delivery of the goods. This period cannot be shortened according to § 438 BGB.

7.2 Warranty:
The warranty applies exclusively to the electronic parts of our products. For scratch furniture or other products that are subject to heavy wear, as well as for cat litter boxes that come into contact with urine, the legal warranty applies, but hygiene products are excluded from exchange.

7.3 Warranty exclusions:
The warranty does not cover damages resulting from improper use, normal wear and tear, or improper handling. For cat litter boxes and other products that come into contact with urine or other substances, signs of use, contamination, and wear are excluded from the warranty.

8. Limitation of Liability

8.1 We are liable for intent and gross negligence according to statutory provisions.

8.2 For simple negligence, we are only liable for the breach of essential contractual obligations, limited to the typically occurring damage.

8.3 These limitations of liability do not apply to damages arising from injury to life, body, or health.

9. Returns and Cleaning Costs

9.1 Returns of products that do not match the description or have defects are free of charge within the withdrawal period. For returns outside the withdrawal period, a cleaning fee applies:

• For cat litter boxes: 75 EUR

• For all other products: 30 EUR

9.2 If the customer returns a cat litter box after the free return period, they must cover the shipping costs of 35 EUR.

10. Customer Service and Telephone Availability

10.1 Our customer service is available by phone from Monday to Friday between 9:00 and 12:00 as well as 14:00 and 16:00.

11. Contract Language, Choice of Law, and Jurisdiction

11.1 The contract language is German.

11.2 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.

11.3 The place of jurisdiction for all legal disputes is our business location in Langenhagen/Hannover, unless the customer is a consumer, in which case the general place of jurisdiction applies.

11.4 Should any provision of these terms and conditions be invalid or unenforceable, the remaining provisions shall remain unaffected.

12. Vouchers

12.1 Vouchers can be used on www.astropet.de and www.petrhein.de redeemed.
12.2 Vouchers can be redeemed until the end of the third year after the year of purchase.
12.3 Only one voucher can be redeemed per order.
12.4 Vouchers are transferable, but retroactive billing is not possible.
12.5 The voucher cannot be used to purchase additional vouchers.
12.6 We reserve the right to refuse the redemption of vouchers if there is suspicion that they are being used fraudulently or were acquired through unauthorized manipulation of the online shop or the vouchers.

13. Subscription Model: Cat Toilets and Cat Litter

13.1 Subscription models for cat toilets and cat litter:

The customer can choose between different subscription models for the Neptune Series cat toilets and Jupiter Series, which are concluded in connection with a cat litter subscription for at least one year.

13.2 Neptune Subscription Option (for 1-2 cats):

• Price: 199.99 EUR for the Neptune cat toilet and 1-year cat litter subscription (3 packages of litter every 12 weeks).

• Payment: The customer pays immediately 199.99 EUR for the toilet and the first 3 bags of litter for a payment of 44.99 EUR and then every 3 months for a payment of 44.99 EUR for the next 3 bags of litter.

• Shipping: The Neptune toilet and the first 3 bags of litter are shipped immediately, the next 3 bags every 3 months. The subscription continues until it is canceled (but at least one year). It is renewed every 3 months and can be canceled with a notice period of 3 months.

13.3 Neptune Subscription Option (for 2-3 cats):

• Price: 149.99 EUR for the Neptune cat toilet and 1-year cat litter subscription (3 packages of litter every 6 weeks).

• Payment: The customer pays immediately 149.99 EUR for the toilet and 3 bags of litter for a payment of 44.99 EUR and then every 6 weeks for a payment of 44.99 EUR for the next 3 bags of litter.

• Shipping: The Neptune toilet and the first 3 bags of litter are shipped immediately, the next 3 bags every 6 weeks. The subscription continues until it is canceled (but at least one year). It is renewed every 6 weeks and can be canceled with a notice period of 6 weeks.

13.4 Jupiter Subscription Option (for 1-2 cats):

• Price: 399.99 EUR for the Jupiter cat toilet and 1-year cat litter subscription (3 packages of litter every 12 weeks).

• Payment: The customer immediately pays 399.99 EUR for the toilet and the first 3 bags of litter for a payment of 44.99 EUR and thereafter every 3 months 44.99 EUR for the next 3 bags of litter.

• Shipping: The Jupiter toilet and the first 3 bags of litter will be shipped immediately, the next 3 bags every 3 months. The subscription continues until it is canceled (at least 1 year). It is renewed every 3 months and can be canceled with a notice period of 1 month.

13.5 Jupiter Subscription Option (for 2-3 cats):

• Price: 349.99 EUR for the Jupiter cat toilet and 1-year cat litter subscription (3 packages of litter every 6 weeks).

• Payment: The customer immediately pays 349.99 EUR for the toilet and 3 bags of litter for a payment of 44.99 EUR and thereafter every 6 weeks a payment of 44.99 EUR for the next 3 bags of litter.

• Shipping: The Jupiter toilet and the first 3 bags of litter will be shipped immediately, the next 3 bags every 6 weeks. The subscription continues until it is canceled (at least for one year). It is renewed every 6 weeks and can be canceled with a notice period of 6 weeks.

13.6 Early Return:

In the event of an early return of the toilet or cancellation of the subscription, the customer must pay the difference between the received price and the original price of the toilet.

14. Data Security and System Integrity

14.1 The customer undertakes not to take any technical or other measures when using our online shop that are aimed at manipulating or bypassing the functionality of the online shop.

14.2 Any attempts to gain unauthorized access to our systems, bypass security measures, or manipulate prices, discounts, or coupon functions are prohibited and may lead to the immediate suspension of the customer account and the cancellation of orders.

14.3 We reserve the right to take appropriate technical and legal measures to maintain system integrity if there is suspicion of misuse of our systems.
